When you buy a ticket for a cruise, you are signing a contract with the cruise line. The contract defines almost every aspect of the relationship between the cruise line and the passenger, including where a passenger may file a personal injury claim in the event of bodily injury. This part of the cruise contract is called the forum selection clause.

Many cruise line companies choose Florida — specifically Miami — as the location where passengers must file a personal injury claim. It does not matter where the cruise ship corporation is registered, where the passenger lives, whether the accident occurred in a foreign port or even on a shore excursion in a foreign country, or whether the cruise ship is owned by a non-U.S. corporation. Any personal injury claim by a passenger against the cruise line will take place in the court specified in the passenger contract.

For example, a passenger may live in California, book a cruise through an agency in Maryland, fly through Orlando to board the cruise ship in Barbados, and have an accident while on a shore excursion in Panama. The cruise line can require the personal injury claim to be filed in Miami — even though the passenger never set foot in Miami.

Forum selection clauses are burdensome for plaintiffs, who may have to travel back and forth to Florida while dealing with severe injuries, scheduled surgeries and rehabilitation plans. It may help the plaintiff to choose a law firm with a strong presence in Florida, so long as that law firm also has extensive experience litigating personal injury claims against cruise line companies.
