Rollover Accidents Still Lead to Fatalities throughout Florida

Late on Halloween night, four teenagers were returning home from a "haunted walk" in Collier County, Florida when the Mustang in which they were riding veered off the road, impacted a concrete culvert, and rolled over. Three of the teenagers were killed and a fourth was able to crawl from the car with serious injuries, according to an NBC news story. Rollover accidents continue to be among the most deadly of all auto accidents.

When a person has been injured in a severe crash, there are many struggles that he may endure, but he does not have to do this alone. The skilled Miami auto accident attorneys at Greenberg Stone and Urbano have more than 100 years of combined experience in getting the damages awards that our clients need to pay for medical treatment, cover accident-related expenses, and compensate them for pain and suffering.

Rollover accidents are most common with SUVs and light pick-up trucks because of the higher center of gravity of these vehicles, but they can happen with all types of vehicles and often lead to severe injuries or fatalities for the driver and all occupants of the car or truck. In the United States, there were more than 8,000 fatal rollover accidents across the country in 2009, according to the United States Census Report. During 2010, rollover accidents accounted for approximately two percent of all accidents in Florida, but led to eleven percent of fatalities.

There was a recent SUV rollover accident near West Palm Beach on February 1, 2014 where an SUV hauling a camper swerved, hit a guardrail, and rolled over, according to the news report in the Sun Sentinel. Thankfully, there were no fatalities, but this does point out one of the widespread causes of rollover accidents.

Our law firm has represented a number of claimants who have been involved in roll-over crashes. One of the most memorable and tragic cases involved the death of a son, brother and father of three, who's Ford Explorer rolled over on a Georgia highway due to defective Firestone tires combined with a flawed design of the SUV. This was one of a number of suc cases and we successfully resolved the case.

The most common cause of a rollover accident is the loss of control of the vehicle by the driver, where the car or truck swerves and then impacts an obstruction that causes the vehicle to roll or flip. The common impact obstacles include:

  • Curbs or raised surfaces;
    Uneven ground;
    Slopes or hillsides;
    Man-made objects;
    Poor vehicle design;
    Catastrophic tire failure;
    Missing or defective guardrails; and
    Natural impediments like boulders or tree stumps which come on to a roadway..

High speeds or aggressive driving can increase the odds of a rollover accident. In addition, a car may be launched into a roll when it is hit by another vehicle. For many years, there were regular reports about SUVs rolling on turns and swerving maneuvers due to a high center of gravity on the SUV's coupled with a wheel base that was too narrow leading to vehicle instability. Although there have been many engineering improvements to these types of vehicles, SUVs and light trucks still face greater odds of rolling in an accident. Mechanical failures or defective parts also could contribute to the occurrence of a rollover accident.

Due to the nature of the accident, including the collapse of the roof area into the driver and passenger compartment, the injuries in this type of accident often are very severe.
