Life Insurance Claims
Section 624.602 of the Florida Statutes defines life insurance as insurance of human lives. A life insurance policy is a contract between an insurance company and a policyholder, where the policyholder agrees to pay a premium and in return, the insurance company agrees to pay an amount of money to a beneficiary named by the policyholder upon the insured’s death. The two most common types of life insurance are:
- Term Life Insurance, which offers low cost insurance over a set number of years
- Whole Life Insurance, which may build cash value and death benefits over time
Since life insurance policies typically pay out substantial sums of money, insurance companies will often use any kind of excuse not to pay the beneficiary. Some of the most common reasons that insurance companies will use not to pay policy benefits are:
- That the policyholder failed to designate a proper beneficiary;
- That the cause of death on the Death Certificate is unclear;
- That the policyholder made a misrepresentation on the application for life insurance;
- That some kind of fraud was committed on the insurance company.
It is worth noting that should a life insurance company deny your claim, they must provide you with the specific reason for their denial, the provision of the policy on which such denial is based and the procedure you must follow to appeal their decision.Miami Life Insurance Claims Attorney
