These statistics highlight the importance of having uninsured motorist coverage, commonly referred to as UM or UIM coverage. This coverage protects the insured when he or she has a car accident with someone that does not have automobile liability insurance or has insufficient liability insurance to fully compensate someone for their injury. UM creates a duty for the insurance company of the covered driver to stand in place of the negligent driver and pay as if it were such driver’s insurer. Under Florida Law, UM coverage must be offered to all those insured for bodily injury (liability) coverage. Moreover, when a person buys liability coverage, a written rejection of UM coverage or an election of UM coverage in amount less than the bodily injury or liability coverage must be signed by the insured. If you own more than one car, you could also elect “stacked” or “unstacked” coverage. This decision is very important. When at all possible, elect “stacked” coverage. What this means, is that if you have, for example 3 cars each with $50,000/$100,000 in bodily injury coverage and $50,000 in uninsured motorist coverage, you then have a total of $150,000 of uninsured motorist coverage available should their be an accident with an uninsured or under insured driver. You arrive at this coverage by adding the $50,000 UM from all three cars.
